FORT BEND BASKETBALL ASSOCIATION (FBBA)
ONLINE WAIVER OF LIABILITY, RELEASE, TERMS & CONDITIONS AGREEMENT
By registering my child for participation in Fort Bend Basketball Association (FBBA) programs, I acknowledge and agree to the following:
1. ASSUMPTION OF RISK
I understand that participation in basketball and related activities involves inherent risks, including but not limited to physical injury, concussion, illness, permanent disability, or death.
I knowingly and voluntarily assume all risks, both known and unknown, including those arising from the negligence of FBBA, its staff, or others.
2. RELEASE OF LIABILITY
To the fullest extent permitted by Texas law, I hereby release, waive, discharge, and covenant not to sue Fort Bend Basketball Association (FBBA), its owners, directors, staff, volunteers, coaches, referees, sponsors, participants, and any facilities used (including but not limited to Missouri City Rec & Tennis Center and Harmony School facilities), from any and all liability, claims, or demands arising out of or related to participation.
This includes claims caused by the negligence of FBBA or any affiliated party.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless FBBA and all associated parties from any and all claims, damages, liabilities, or expenses (including attorney’s fees) arising from my child’s participation.
4. MEDICAL AUTHORIZATION
I authorize FBBA representatives to obtain medical care for my child in the event of injury or emergency if I cannot be reached.
I understand and agree that I am financially responsible for any medical treatment provided.
5. CONCUSSION & INJURY ACKNOWLEDGMENT
I understand that basketball is a contact sport and may involve the risk of concussions or other injuries.
I agree to:
- Remove my child from play if injury is suspected
- Seek appropriate medical attention when necessary
- Follow return-to-play guidelines recommended by a medical professional
6. MEDIA RELEASE
I grant permission for FBBA to use my child’s name, image, and likeness for promotional, marketing, and advertising purposes (including social media, website, and print) without compensation.
7. CODE OF CONDUCT (PLAYER & PARENT)
I agree that both I and my child will follow all FBBA rules and expectations.
I understand that:
- Parents must remain in designated spectator areas
- Coaches and referees must be treated with respect
- Disruptive, abusive, or inappropriate behavior will not be tolerated
FBBA reserves the right to remove any player or parent from games or the league for misconduct, without refund.
8. NO REFUND POLICY
I understand and agree that:
- All registration fees are non-refundable, except in cases approved solely at FBBA’s discretion
- Failure to attend evaluations, practices, or games does not qualify for a refund
- Once teams are formed, no refunds will be issued under any circumstances
9. EVALUATIONS & TEAM PLACEMENT
I understand that:
- Teams are formed after evaluations
- Specific team placement, coach requests, or uniform sizes cannot be guaranteed
- If my child misses evaluations and does not request a refund prior to evaluation day, they will still be placed on a team
10. SCHEDULING & FACILITY CHANGES
I understand that schedules, locations, and times may change due to gym availability, weather, or unforeseen circumstances.
FBBA is not responsible for conflicts and will make reasonable efforts to communicate updates.
11. HEALTH & PARTICIPATION
I certify that my child is physically able to participate and has no medical condition that would prevent safe participation unless disclosed.
12. GOVERNING LAW
This agreement shall be governed by the laws of the State of Texas.
13. ELECTRONIC CONSENT & LEGAL AGREEMENT
By checking the agreement box and completing registration, I acknowledge that:
- I have read and fully understand this agreement
- I understand I am giving up important legal rights, including the right to sue
- I agree voluntarily and accept all terms
- My electronic acceptance is legally binding and equivalent to a handwritten signature
